			<content:encoded><![CDATA[askelouise@cobellsettlement.com <br />Ask Elouise<br />January 20, 2012<br />Dear Indian Country<br /><br />Following the passing of our leader and friend, Elouise Cobell, Class Counsel is responding to your continuing questions and concerns regarding the settlement of the Cobell lawsuit.<br /><br />What is the current status of the settlement? Unfortunately, notwithstanding the hopes and wishes of 500,000 individual Indians and despite Class Counsel&#8217;s best efforts, the settlement has been delayed by 4 class members, each of whom is challenging the landmark settlement in the U.S. Court of Appeals for the D.C. Circuit. We expect that these appeals will be resolved in another 6 months, provided that no appellant seeks further review in the Supreme Court.<br /><br />But for these appeals, your Historical Accounting Class payments would have been distributed before Thanksgiving 2011, and it is likely that your Trust Administration Class payments would have been made by Easter 2012.<br /><br />However, because of the appeals, your Historical Accounting Class and Trust Administration Class payments cannot be made until after the appeals have been resolved, provided that we prevail on appeal. No one knows when that will occur. Historical Accounting Class payments should be made within a few weeks after the appeals are decided. Trust Administration Class payments should be made within about 6 months after you receive your Historical Accounting Class payment.<br /><br />Class Counsel understands your increasing frustration and concerns. We know the difficulties many of you face and we have spoken to hundreds of you who are in extremis this winter season. It is with our utmost sympathy and disappointment that we share this unfortunate news.<br /><br />Who is appealing? And, why are they appealing? Your payments are being held-up by 4 people: Kimberly Craven (Sissten-Wahpeton Oyate), Charles Colombe (Rosebud Sioux), Carol Eve Good Bear (Fort Berthold Reservation), and Mary Lee Johns (Cheyenne River Sioux). Notably, Colombe, Good Bear and Johns are represented by David (Davey) Harrison, an Albuquerque lawyer and former BIA employee.<br /><br />Their reasons vary slightly, but are the same on one fundamental point. At bottom, each believes that you are not entitled to the relief (nor the payment of your trust funds) that has been provided in the settlement agreement notwithstanding a century of abuse, malfeasance and breaches of trust by the United States government. Each of the appealing class members has filed papers that will kill the settlement if any one of them prevails on appeal. This means that you would receive nothing from the settlement: no payment, no scholarship funds, no land consolidation, and no further trust reform.<br /><br />Craven has railed against the settlement since it was first announced over two years ago, going so far as to claim: &#8220;after 14 years of acrimonious litigation, the Cobell plaintiffs are entitled to no monetary recovery whatsoever from the courts.&#8221; (http://thehill.com/blogs/congress-blog/judicial/112807-bailing-out-the-smartest-guys-in-the-room). Mary Johns has sought to remove the judge who approved the settlement, Thomas F. Hogan. There is little doubt that they do not share the desires or care about the needs of the class, over 99.9% of whom support a prompt conclusion to this long-running, acrimonious case.<br /><br />Why would anybody appeal? I&#8217;d like to contact these class members, how do I do that? We know of no explanation for their behavior that is consistent with your best interests. No. Class Counsel has reached out to the 2 attorneys who represent the 4 appealing class members to resolve or settle whatever issue they may have with the settlement. However, we have been rebuffed or ignored each time. Unless each of the appealing class members withdraws his or her appeal, there is no way to shorten the judicial review process.<br /><br />Haven&#8217;t you been paid? Class Counsel has not been paid. 			<content:encoded><![CDATA[Elouise Cobell, an enrolled member of Montana's Blackfeet Tribe who led a 16-year landmark legal fight to get the federal government to pay an estimated 500,000 Native Americans for mismanaging their trust accounts, died Sunday at Benefis Hospital in Great Falls, Mont.<br /><br />A great granddaughter of Mountain Chief, one of the legendary Indian war chiefs, Elouise had been diagnosed with cancer a few weeks before her class-action lawsuit was given final approval by Judge Hogan in Washington, D.C. on June 20, 2011.<br /><br />Born on the Blackfeet Reservation on Nov. 5, 1945, Ms. Cobell was one of eight children.<br /><br />Her survivors include: her husband, Alvin Cobell of Blacktail, Mont., a son, Turk Cobell and his wife, Bobbie, of Las Vegas, two grandchildren, Olivia, and Gabriella, a brother, Dale Pepion of Browning, Mont., and three sisters, Julene Kennerly of Browning, Mont., Joy Ketah of Seattle and Karen Powell of Browning, Mont.<br /><br />Ms. Cobell will be remembered as an extraordinary person as well as a warrior and uncommon leader. Ms. Cobell drew the line in the sand and told the government "no longer, no further, and no more." Against seemingly insurmountable odds, Ms. Cobell never backed down in her selfless fight for justice for the most vulnerable people in this country and concluded this long-running case for the largest settlement involving the government in American history. A true hero is gone today and everyone should be thankful for her sacrifice and enduring spirit. We may never see the likes of her again. 			<content:encoded><![CDATA[Here is a poem I've written about some of the things I've seen regarding Native Americans fitting into modern American society.<br /><br />UnExtinct<br /><br />What is this?<br />Oh no, but they do love to study - <br />Study our culture, study our ways,<br />Study our language and beadwork in trays,<br />Study our diet, strength and endurance they know,<br />Study our fight and then study our bones!<br /><br />They really are an educated lot,<br />All those certificates and degrees;<br />They have a lot to do and so very much to say,<br />But when a true Native American <br />Stands right in front of them,<br />They look the other way!<br /><br />What is it?<br />Is he too fierce, too dirty, too foreign, too strange?<br />You can't speak his language,<br />So you turn and walk away.<br />Is it that he still exists, he's more than just a page<br />In a book you can open and close and when needed put away?<br /><br />You may not like his thinking, his stance, his accent<br />Or the way he makes you feel.<br />You may not like his feathers, pride, or perhaps his sex appeal,<br />But that's not it. 			<content:encoded><![CDATA[I learned this weekend that I have believed a lie for 23 years!  When Nagpra (Native American Graves Protection and Repatriation Act) went into effect, I remember myself and the Native group I worked with being told that the old ones (the skeletons in the burial mound) in the place that I call home, would be reburied (covered over) right where they were to rest in peace.  I found out this weekend that the old ones are not there!  They were taken and are in boxes in the back room of the museum.<br />For 23 years, I have visited this place believing the old ones were there for me to commune with.  Indeed, their spirits were good enough to meet me there, but now I know the truth.<br />I have read Nagpra for myself, and it has so many loopholes in it, it leaks like a sieve.  There is nothing anyone can say or do about this situation.  The museum is in its rights by this act.<br />Not only was I lied to, but so was the Choctaw nation (who helped care for the place).  They were told the same thing.<br /><br />And sadly, now I watch the place I call home being taken and run entirely by non-natives who don't understand.  The pow wows have stopped, and almost all the Native people have gone away.  I feel like the last voice to speak.  I am hurt.  I am angry.  I am sad.<br /><br />My daddy used to say that most people aren't worth a dam(n)? with a hole punched in it.  Now I know too well what he means.  Is there nothing we can do?  What should I use my voice to say?  The government machine legalizes itself.  What words will anyone care to hear now?]]></content:encoded>

There has been no activity in the forums since early July (2011). When people check in and find their photos deleted AGAIN and/or all Friends emptied out and/or profile history gone it just may be the last time for that person.<br /><br />What is some helpful feedback to Paul? Let's use this thread to give specific feedback to Paul about what the webmaster is doing that defeats the purpose and fun of MTS and what he is doing right. Eh?]]></content:encoded>
